GALBA’S RESPONSE TO THE CALL FOR EVIDENCE ABOUT LBA’S PLANS FOR MORE NIGHT FLIGHTS

 

After pressure from GALBA members and local residents, Leeds City Council agreed to consult with the public about LBA’s proposals to reinterpret the night flight rules and allow more planes to fly between 11pm and 7am.

 

GALBA has sent a detailed response to the Council’s ‘call for evidence’ about LBA’s CLEUD applications. Along with our legal advisers, we looked at the applications in forensic detail and found the airport’s evidence was full of holes, inconsistencies and cover-ups.

 

Our legal advisers have told the Council that three of LBA’s five applications do not constitute lawful CLEUD applications under the relevant sections of the Town and Country Planning Act. Therefore the Council has no choice but to reject these applications.

 

For the other two applications, LBA’s evidence is inaccurate and inconsistent in many respects. The breaches of the rules on which LBA relies in Application 1 were not continuous. In any event, LBA concealed the breaches relied on in both Applications 1 and 3, meaning that LBA cannot benefit from the CLEUDs.
